Japan court rules Samsung didn't violate Apple sync patent

Apple Inc. (Nasdaq: AAPL) lost a patent lawsuit in Japan as a Tokyo judge ruled that Samsung Electronics Co. smartphones and a tablet computer didn?t infringe on an Apple invention for synchronizing music and video data with servers.

Apple was ordered by Tokyo District Judge Tamotsu Shoji on Friday to pay costs of the lawsuit after his verdict, the latest decision in a global dispute between the technology giants over patents used in mobile devices. Samsung shares rose, erasing earlier losses.

?It?s hard to believe the products belong to the range of technologies of the claimant,? Shoji said in dismissing Apple?s case.

Apple and Samsung are battling over the smartphone market, estimated by Bloomberg Industries to be worth $219 billion last year, with patent disputes being litigated on four continents. Apple won a $1.05 billion verdict in the U.S. on Aug. 24, with a jury finding that Suwon, South Korea-based Samsung infringed six of seven patents for mobile devices. The two companies are also bound by commercial deals involving components supply.

Apple, the maker of iPhones, sued Samsung, the world?s biggest maker of mobile phones, in Tokyo last year, claiming the Galaxy S, Galaxy Tab and Galaxy S II infringed the patent on synchronization, and sought 100 million yen ($1.3 million) in damages, according to court documents. The Galaxy series of products in Japan is offered by NTT DoCoMo Inc., the country?s biggest mobile-phone company.

Samsung Shares

Samsung welcomed the decision, the company said in a statement. Carolyn Wu, a spokeswoman for Apple, declined to comment.
The Tokyo court also ruled out today an injunction request by Apple to bar Samsung from offering 8 models of Galaxy products in Japan, said Kenichi Hasegawa, a Tokyo-based spokesman for Samsung.

Samsung doesn?t provide sales figures for Japan. The company generated about 12 percent of its revenue from Asia, excluding South Korea and China, in the quarter ended June 30, according to data compiled by Bloomberg.

Cupertino, California-based Apple got 5.7 percent of its sales in Japan during the same period, according to the data.

IPad, IPhone Bans

?This will likely turn the tide in favor of Samsung,? said Kim Hyung Sik, Seoul-based analyst at Taurus Investment Securities Co. ?Samsung had this win in a country that?s strong at intellectual property. The mood is turning positive for Samsung.?

Samsung?s method of synchronizing multimedia content between mobile devices and computers installed with its Kies software doesn?t infringe a patent held by Apple, the Japanese court said in a statement.

The software distinguishes a file by its name and size, contrary to Apple?s claim it uses other information such as the length of content to recognize which files need synchronizing, according to the statement.

NTT DoCoMo will keep making efforts to prevent patent disputes, Naoko Minobe, a spokeswoman for the Tokyo-based carrier, said by phone today.

U.S., Korea Rulings

Both companies were barred from selling some phones and tablet computers in South Korea on Aug. 24 when a Seoul Central District Court ruled they infringed each other?s patents.

Apple was ordered to stop selling the iPhone 3GS, iPhone 4, iPad 1 and iPad 2 in South Korea, while Samsung must stop selling 12 products including the Galaxy S, Galaxy S II and Galaxy Tab. Apple was also ordered to pay Samsung 40 million won ($35,000) and the?South Korean company must pay its U.S. rival 25 million won for the patent infringments.

In the U.S., where Samsung had been barred from selling the Galaxy 10.1 tablet, Apple sought to extend the ban to eight models of Samsung smartphones following the jury verdict. U.S. District Judge Lucy Koh in San Jose, California, has scheduled a Dec. 6 hearing on Apple?s request.

In Australia, a preliminary ban on Galaxy 10.1 tablet sales was overturned by the highest court in December. A judge last month began hearing Samsung?s claim that Apple products infringe its patents on wireless transmission. That trial also includes Apple?s claim that Samsung phones and tablets infringe its patents on touch-screen technology.

Samsung retained its position as the world?s biggest seller of smartphones in the second quarter, holding about 35 percent of the market, Strategy Analytics said in July. Apple had the second slot with about 18 percent, according to the market researcher.

Fish sale in progress in Ottawa County - Blade Outdoors

They are used in ponds to control vegetation -- preferring to eat leafy, rooted aquatic plants such as pondweed and coontailand -- but they will also eat floating duckweed, green algae and even cattails. The fish supplied for the sale come from Fender?s Fish Hatchery in Baltic, Ohio. A tank truck will arrive at the soil district office at 240 W. Lake Street, Oak Harbor, on Thursday, Oct. 4 and fish that have been ordered during the sale will be distributed from 2-4 p.m. All fish must be pre-ordered and pre-paid. What the Drudge Report can tell you about the stock market

These days, low volume and volatility are creating a degree of fear in the market. It started slowly with Countrywide, New Century Financial and Bear Stearns, but erupted with Fannie Mae, Freddie Mac, AIG, and Lehman Brothers. In September 2008, Wall Street was sinking and taking Main Street with it. Nobody knew what was going to unfold, how far the subprime mortgage contagion had spread, or when the subsequent global sell-off would abate.

The financial crisis changed us. It left our sentiment scarred, our nerves on edge, but also increased our awareness of the financial and economic climate. It turned financial news into front page news.

Last year Bespoke Investment Group began tracking the occasions when financial stories "cross over" to become mainstream news. Using one of the most widely visited general news/political websites, DrudgeReport.com as the barometer, Bespoke found a strong correlation between the number of financial stories that ran as the top headline and the condition of the stock market. Hickey points out that the first significant peak, 21 days out of 50, was hit on February 27, 2009; just ten days before the S&P 500's bear market bottom on March 9. Last August during the debt ceiling debate and U.S. credit rating downgrade, the indicator broke to a new high ? 22 of 50 days. Following that peak, the market bottomed.

So where do we stand today? Bespoke's Drudge indicator hit an all-time high in June with 24 of 50 days running financial stories as leading headlines. This is when Europe re-emerged and the market hit summer lows. Since then the S&P has rallied 11%.

"What the takeaway is, is that once Drudge is talking about it [a financial story], and everyone is talking about it, then the market has digested it," says Hickey. So what we have is a classic contrary indicator. When Drudge financial headlines rise, the market is at or near bottom.

"Interestingly, the highs it's made each of the last couple of years has been even higher than what we saw during the financial crisis," he notes. "I think the reasoning behind that is the fact that once we had the financial crisis, finance became a much bigger part of everybody's world."

Take it for what it's worth, but never let a good indicator go unnoticed. The next time you see a string of financial news headlines topping the Drudge Report, it could just be your next great buying opportunity.

Ex-U.S. Sen. Arlen Specter of Pa. says he has cancer again

PHILADELPHIA (AP) ? Former Sen. Arlen Specter confirmed Tuesday that he is fighting cancer again, calling the latest diagnosis "another battle I intend to win."

The 82-year-old Specter issued a brief statement through his Philadelphia office. A family spokesman reached by The Associated Press declined to comment on the type of cancer or confirm news reports that he had been hospitalized.

Specter, who was Pennsylvania's longest-serving senator, has overcome two bouts with Hodgkin's disease, a cancer of the lymphatic system, since 2005. He also has survived a brain tumor and cardiac arrest after bypass surgery.

In his statement, he said: "I'm battling cancer. It's another battle I intend to win. I'm grateful for all the well wishes I've received. I'm looking forward to getting back to work, to the comedy stage, to the squash court and to the ballpark."

In retirement, among other activities, Specter occasionally performed standup comedy at clubs in Philadelphia and New York. He played squash nearly every day into his mid-70s.

His 30-year career ended after he switched from the Republican Party to the Democratic Party. He lost the Democratic primary in 2010, and Pennsylvania voters elected conservative Republican Pat Toomey, then a congressman, to replace him.

The Real Housewives of New York City Recap: Pirate Booty Call


The Real Housewives of New York City head to St. Barts for a girls week but did a fun filled night turn into a "Pirate Booty Call" for one housewife?

We break down the lies, confessions, and speculation here in THG's +/- recap.

The ladies fly into to St. Barts and I must agree with Aviva and Carole.  That looks like a small plane and a bumpy ride.  Plus 10 to Carole for holding it together given her history.

The island is gorgeous. The house is beautiful and the chef is hot.  Plus 8.  What more can you ask for from a vacation?

Well, apparently admiring the eye candy isn't enough for some but we'll get to that in a bit.

Sonja & Ramona Drink

Plus 15 goes to Carole.  Love her analogy about dealing with Ramona.  Sometimes in order to avoid the toddler tantrum you just give her the lollipop.  In this case Ramona got the master suite. 

Of course she and Sonja decide to share not only the room but the bed.  Minus 7.  These two can't seem to spend ten minutes apart from one another or their favorite drink but I guess it is a girls vacation. 

Sonja says she'll be the buffer between Ramona and well, basically everybody else but especially Heather.  Minus 9.  Perhaps she would have done a better job is she hadn't been drunk most of the time.  And I'm with Heather.  I'm tired of hearing about this nonexistent toaster oven.  I have a toaster oven at home.  They're really not all that exciting. 

Maybe I just need to buy Sonja's cook book.

Poor Heather runs smack into a glass wall and damn near breaks her nose.  I suppose that's the price you pay for enjoying those killer views.  Plus 8 because she readily laughed at her own klutziness.  

For a girl's week there were certainly a lot of men in the picture.  First Carole's boyfriend Russ shows up and plus 10, because he is a hottie and he handles the ladies drunken craziness well. 

Sonja on the other hand is on the hunt for a man and she's not too picky about who.  Has it been that long or is it the banana rum talking?  Unfortunately for Sonja it doesn't look like she'll be feeling anyone up other than Ramona and the poor butler who can't get away.

Sonja takes the ladies out for a night on the town that includes plenty of tequila,  some skimpy pirate outfits, and a Johnny Depp look alike.  Eventually these drunken wenches make their way home but someone's got company.

St. Barts Booty Call

Minus 15.  LuAnn and Tomas, aka Johnny Depp stumble into her room at 3am.  Oh Countess what have you done? 

In the next few scenes we watch her lie to Jacques on the phone and then try to cover her tracks with the ladies.  Perhaps she should have remembered she was wearing a mic. 

It's a small island and an even smaller house.  How long before Ramona spills the beans to Jacques?  Will the Frenchmen take it in stride or will their baby plans be put on hold?  We'll all have to check back in next week as the St. Barts adventure continues.

(Special from Kaiser Health News) ? What will it take for Americans to age successfully in place, rather than have to bounce from home to assisted living to nursing home and so on? This question has immediate importance for policymakers and families as an estimated 10,000 baby boomers turn 65 every day.

It?s the subject of a new book, Independent for Life: Homes and Neighborhoods for an Aging America, (University of Texas Press) authored by more than a dozen leading experts in aging and housing and co-edited by Henry Cisneros, a four-term mayor of San Antonio and former of the U.S. Secretary of Housing and Urban Development.

Cisneros, who now runs a company specializing in urban real estate, spent an hour discussing his thoughts about aging in place with Kaiser News Service reporter Judith Graham. That interview has been edited for length and clarity.

Q: You start this book talking about your elderly mother. Tell me about her.

Henry Cisneros: My Mom and Dad bought the home across the alley from her mother?s home in 1945. It was a lower-middle-class neighborhood of civil service workers?all Latinos. It had the feeling of a Norman Rockwell picture, only all the faces were brown.

My Dad passed away in 2006 at age 89, having had a stroke some years before. But my Mom, 87, lives there still. The house is essentially the same as it was, with some adjustments. We put a ramp on the side of the house leading to a deck. We raised the toilet, lowered the sinks, created a walk-in shower. Changed the lighting in the den so my Dad could read. Put in window guards, an alarm and outdoor lighting for my Mom because the neighborhood is somewhat in decline.

Q. Do you see her often?

Henry Cisneros: I try to visit her about every second or third day, but I talk to her every day by phone. She is a classic case of a person aging in place. She?s a healthy, lanky, tall woman who?s always been physically strong. But in recent years she?s started to slow down. She manages all her own affairs. I don?t think there?s a tractor strong enough to pull her from that house.

Until recently, on three sides, all her neighbors were her age or older. The lady to the left died this year at 97. The lady to the right went to a nursing home and died in her late 80s. And the lady across the street died at 90-plus. All stayed in their homes until very late. Aging in place in that neighborhood means older women living on their own.

Q. What lessons do you take from your mom?s experience?

H.C.: Seniors fear being unable to communicate, being lonely, feeling insecure. Especially people who all their lives have had other people around them?family, neighbors?and now they go entire days and never see anybody.

Imagine being older, a step slower, a bit more fragile. Add to that being lonely, edging to depression and unsure about how you?re going to get everything done that you used to do?but wanting above all to stay in your own home and keep on being independent. That?s hard.

Q. What kinds of policies do you think are needed?

H.C.: First, I?d like to see us commit as a nation to creating lifelong homes. Only four percent of the 65-plus population goes to a nursing home. Most are at home for a long, long time. We should make this a priority, just as we did with creating more energy-efficient homes.

This could involve certifying a package of age-related home improvements?the kinds of things we did for my parents?and coming up with public and private strategies for financial support.

Second, we ought to be thinking about how we accessorize communities for an aging population. Today, we build parks for children. Imagine a park where older people would have stations for exercise. Think about age-appropriate recreation facilities. Think about how we make transit available, so people who no longer drive can get to the doctor.

As we build new communities we should focus on walkability?making sure that older people can walk to facilities they need, like groceries and pharmacies.

Q. Can you point to examples?

H.C.: There are communities that are now rethinking zoning policies so that granny flats can be built on the same lots as larger size homes. Davis, Calif., has rethought its zoning codes with that in mind.

There are places using the high school library as the community library. So, elderly people can work there or volunteer there and interface with the next generation.

I think we?ll be recycling older communities in many parts of the U.S.?clearing away obsolete buildings and reconfiguring them as elderly housing. The recession has created a lot of sites that are no longer economically viable. Strip centers, even regional malls are being remade with housing for the elderly in mind.

We also need to generate prototypes for new age-appropriate homes for people who are leaving McMansions and looking for a smaller home.

Q. What about affordable housing?

H.C.: We need to double down on very successful programs that have produced affordable housing for the elderly. Low-income housing tax credits?we need more. And HUD?s Section 202 (supportive housing for the elderly) program?we need more of that. In some respects, this is the least problematic area because we know what to do?we just need to do more of it.

What we don?t know how to do very well is help people who are middle-class, but who are about to fall off the dual cliff of aging and frailty while living on fixed incomes and aging in place.

Q. Yet, this is an era of budget cuts. How do you make the case for more financial assistance for programs of this kind?

H.C.: As a country, we owe it to our seniors. It?s the right thing to do. It is unacceptable to leave a large segment of the population on their own at the most frail time of their lives. I also think we can make the case that cost savings can be achieved by keeping people living independently as long as possible instead of going to assisted-living or nursing home facilities.

Q. What about the suburbs?

H.C.: The baby boomers are the first American suburban generation. But the suburbs are the worst place to age because they?re so unwalkable and totally dependent on the automobile. Living in a cul de sac is really hard when you lose access to your car. So these communities have to think of new strategies.

Q. One of the authors in your book writes about his personal longevity plan. Do you have one?

H.C.: I turned 65 this year and I do have a plan that involves daily exercise and fitness. My personal role models are people who don?t think about retirement but have created either businesses or activities that will allow them to be active until the very end.

I will always be based in San Antonio. I live in my grandfather?s old house, which I refurbished, one mile away from where I grew up and one block away from our neighborhood church. When you give this much to a place it becomes part of you and there are a lot of things you don?t want to abandon.

Navistar CEO steps down, interim replacement named

LISLE, Ill. (AP) ? Navistar International Corp. said Monday that its CEO has stepped down and named an interim replacement.

The heavy truck and engine company said that Daniel Ustian, 62, informed the board that he is immediately retiring from his roles as chairman, president and chief executive, and is leaving the company's board. He had been with the company for 37 years. He became CEO in 2003 and chairman in 2004, the company said.

Lisle, Ill.-based Navistar named Lewis Campbell, the former chairman, president and CEO of Textron Inc., as its executive chairman and interim CEO.

Navistar has struggled this year amid uncertainty about whether its Class 8 engine, which is used in the largest commercial trucks, will get Environmental Protection Agency approval. Since the beginning of this year, its shares have tumbled 39 percent.

The company said in July that it was in talks with the EPA on a plan that will allow it to continue shipping trucks while it makes a transition to a new emission-reducing technology that will bring it into compliance with EPA requirements. The new technology is expected to be available beginning early next year.

Its shares rose 34 cents, or 1.5 percent, to close at $23.32 Monday after rising as high as $25.08 earlier in the day.

Campbell joined Providence, R.I.-based Textron in 1992 and served as its CEO from 1999 to 2010. Before that, he spent 24 years at General Motors in a variety of roles.

Campbell, 66, said that "at the appropriate time" the company will conduct a search for a long-term CEO, which will include both internal and external candidates.

Navistar also said Monday that it promoted Troy Clarke its current president of truck and engine operations, to the job of president and chief operating officer. Clarke, 57, joined Navistar in 2010 and previously spent 35 years at General Motors.

The task was complicated by the fact that a number of the remains carried away had been buried in an unmarked pauper's grave. Today remains of 23 bodies have been temporarily interred in concrete vaults while repairs to the cemetery continue, and unidentifiable remains are still being cataloged and occasionally uncovered.

"I never want to do it again," says Hardy, of the cleanup job. "For some years to come I anticipate we'll continue to make minor discoveries. Some hunter, some fisherman, some homeowner working along the back of their fields will make a discovery and we'll get a call."

Refinery blast kills 24 in Venezuela, dozens hurt

CARACAS, Venezuela (AP) ? A huge explosion rocked Venezuela's biggest oil refinery early Saturday, killing at least 24 people and injuring more than 80 others in the deadliest disaster in memory for the country's key oil industry.

Balls of fire rose over the Amuay refinery, one of the largest in the world, in video posted on the Internet by people who were nearby at the time.

At least 86 people were injured, nine of them seriously, Health Minister Eugenia Sader said at a hospital where the wounded were taken. She said 77 people suffered light injuries and were released from the hospital.

Officials said those killed included a 10-year-old boy, but that most of the victims were National Guard troops stationed at the refinery.

Vice President Elias Jaua, who traveled to the site in western Venezuela along with a team of top officials, said the authorities were "trying to save the greatest number of lives."

Officials said firefighters had controlled the flames at the refinery on the Paraguana Peninsula, where large clouds of smoke were rising at daybreak.

Oil Minister Rafael Ramirez said the state oil company should be able to "restart operations in a maximum of two days."

"We have sufficient supplies... in the entire country, and our production at the maximum to deal with any situation in our domestic market," Ramirez said. "In that sense, we won't have major effects."

An official of the state oil company, Petroleos de Venezuela SA, said the country also has enough supplies on hand to guarantee its international supply commitments. The official spoke on condition of anonymity because he wasn't authorized to speak publicly about the matter.

The blast occurred after 1 a.m. when a gas leak created a cloud that ignited, Ramirez said. Some nearby houses were damaged by the blast, he said.

"That gas generated a cloud that later exploded and has caused fires in at least two tanks of the refinery and surrounding areas," Ramirez said. "The blast wave was of a significant magnitude."

Images in early hours after the blast showed the flames casting an orange glow against the night sky. One photograph showed an injured man being wheeled away on a stretcher.

"The areas that had to be evacuated were evacuated," Falcon state Gov. Stella Lugo said on television, according to the state-run Venezuelan News Agency. "The situation is controlled. Of course they're still a fire rising very high, but ... the specialists tell me there is no risk of another explosion."

Ramirez said oil workers will determine what caused the gas leak and were inspecting the damage along with troops. Ramirez said that nine storage tanks were damaged. He said supplies of fuel had been cut off to part of the refinery, and that the fire had been brought under control.

"At this time, the situation is controlled," Jaua said on television, while smoke continued to rise from the refinery. Jaua said earlier on his Twitter account that the military was deployed to the area and that air ambulances were dispatched to ferry the wounded.

Amuay is part of the Paraguana Refinery Complex, which also includes the adjacent Cardon refinery. Together, the two refineries process about 900,000 barrels of crude per day and 200,000 barrels of gasoline. Venezuela is a major supplier of oil to the U.S. and a member of the Organization of Petroleum Exporting Countries.

Syrian captors release Lebanese hostage

One of 11 Lebanese Shiite pilgrims taken hostage by Syrian rebels in May has been released and is now in Turkey, a Turkish foreign ministry spokesman told AFP Saturday.

"It is clear that such actions as hostage-taking will benefit nobody in the region which has been passing through a delicate time," the ministry said in a statement. "Putting an end to such actions without harming anyone is quite important for regional stability."

Omar first appeared in a video aired by Al-Jazeera television on Saturday, crossing the border into Turkey and then praising his captors on the Doha-based channel, insisting that he and the others were "guests, not captives."

"We call on the Lebanese people and the dormant Arab peoples to stand up and support this oppressed people of Syria," he said in the footage.

The captors said in a statement that Omar was released as a "goodwill gesture" in response to a request by a group of Lebanese Muslim clerics, as well as a request by an unnamed aide to Turkish Prime Minister Recep Tayyip Erdogan.

But the speaker said the release does not mean the captors have abandoned an earlier demand for Lebanon's Shiite militant group to "determine its position regarding the Syrian people and the Syrian revolution."

Iran and Syria-backed Hezbollah are staunch allies of the regime of President Bashar al-Assad.

The statement said the fate of the remaining captives would be determined "after sending letters to countries neighbouring Syria, as well as all Arab and Muslim states, to inform them of the truth about the Syrian revolution."

The pilgrims were kidnapped in Syria on May 22 while on their way home from Iran.

Unverified Lebanese media reports that some of the pilgrims had been killed in an air strike on the northern Syrian town of Aazaz earlier this month triggered a spate of violence against Syrians in Lebanon.

The release followed mass kidnappings this month in Lebanon including two Turkish nationals, prompting the Ankara government to advise its nationals to avoid non-essential travel to the country that has been battling to contain an eruption of violence triggered by events in neighbouring Syria.

Several oil-rich Gulf countries have ordered their nationals to leave the country immediately in the face of threats, particularly against Saudis and Qataris whose governments are staunch opponents of the Syrian regime.

Turkey is home to thousands of refugees in its camps along the Syrian border and also provides sanctuary for rebel forces made up of army defectors in a separate camp where security is tighter.

Turkish officials denied any linkage between the kidnapping of Lebanese citizens in Syria and the abduction of the two Turks in Lebanon.

I have many passions, and music is one of them.? Classical music to be exact.? My roommates in College?thought I was a little off my rocker because I would study to Vivaldi and fall asleep to Chopin (they made me wear headphones).? I would prefer that dates take me to campus orchestra recitals instead of a movie.? The funny thing is, I never had the desire to play an instrument myself, but I sure do love the energy that comes from hearing an orchestra play!? I am grateful to have a daughter who at only 12 years old?is in her 4th year of playing the violin.? It brings me such joy to hear her play.? ASUNCION, Paraguay (AP) ? Imagine being stuck in a cage for two months while going through customs. That's the border limbo 16 tigers and lions have faced in Paraguay because Argentine officials refuse to approve their paperwork for re-entry.

The nine Bengal tigers and seven African lions belong to an Argentine circus that performs in the Paraguayan capital each August. Their owner, Oswal Wasconi, brought them back for this year's circus only to learn that a new law in Paraguay bans live animal acts at circuses.

With no chance of performing, Wasconi tried to ship his big cats back to Argentina. But then they got stuck at the border.

Estela Gomez, director of Paraguay's wildlife agency, said the animals all have good-health certificates, but their entry to Argentina was blocked by officials demanding more information about the protected species.

Aides to Argentina's quarantine office director, Raul Castelli, said he was in a meeting and could not explain the holdup.

After inquiries from The Associated Press on Friday about the cats' plight, Gomez said her ministry decided to move the big cats two by two to the Asuncion zoo, "so that they can live in some comfort and not in a strange area."

Furthermore, she said that "Wasconi has promised to provide them with food and liquid because these animals are physically quite large."

"In the next few days we will continue investigating the true reasons why the Argentine authorities aren't authorizing their return," she said. "I can't anticipate whether these beasts will remain forever in Paraguay or eventually go to Argentina."
